USER TERMS AND CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the service (“Service”) within the website (“Platform”) provided by EON Capital Sdn. Bhd., Registration Number: 202301044733 (1538649-K) (“ECSB”). By using the Platform, you agree to be bound by these Terms. ECSB reserves the rights to amend the Terms from time to time. Any person that you allow to access the Service using your Account shall also be bound by these Terms. If you do not agree, please do not continue with the registration process or usage of the Service in the Platform.

Definitions

For the purpose of the Terms, the following terms shall have the meanings as defined below:-

“Financial Partners”   means authorized financial institutions regulated under the Financial Services Act 2013 and/or the Islamic Financial Services Act 2013, credit companies licensed under the Moneylenders Act 1951, or credit reporting agencies regulated under the Credit Reporting Agencies Act 2010, appointed by ECSB to process your loan application, provide financing (where applicable) or other related services through the Platform.  
“CS” means ECSB’s customer support representative which can be contacted during operational hours;  
“Customer” means any individual who accesses or uses the Platform, either directly or indirectly, for purposes such as browsing, using tools like the CarCulator, or engaging with services including vehicle loan application submissions. This includes individuals who submit loan applications themselves, as well as those whose applications are submitted on their behalf by an authorized Sales Representative through the Platform, even if they have not personally interacted with the Platform;  
“Dealer” means the company or entity that is authorized to sell vehicles and participates in the Platform as a registered partner dealer. This includes its appointed sales agents/consultants (sales representatives), sales managers, and administrative staff who are granted access to the Platform to assist customers in the car purchasing and loan application process;  
“Loan Application” / “HP Loan Application” means the hire purchase loan application that is submitted by yourself, or the designated Sales Representative of the Dealer;  
“Operational Hours” means the period during which the Platform’s customer support team is available to respond to user inquiries or assist with issues. Unless otherwise stated, Operational Hours are from 9:00 AM to 5:00 PM, Monday to Friday, excluding weekends and public holidays;  
“Personal Information/Data” means any information relating to you as defined under the Personal Data Protection Act 2010, collected or processed by ECSB for the provision of the Service, either directly or indirectly, including but not limited to your name, address, telephone number, identification number, financial information, and any other data that can identify you as an individual;  
“Sales Representative”   means any individual affiliated with a partner dealership who is authorized to access and use the Platform to assist Customers with vehicle selection, financing options, and the submission of loan applications. This includes the use of tools such as the CarCulator to simulate financing scenarios and provide guidance. Sales Representatives may also offer or facilitate the sale of optional products or value-added services provided by ECSB, where applicable;  
“Service” means the features, tools, functionalities, and processes made available through the Platform, including but not limited to HP Loan Application submission, eligibility checks, communication between users, status tracking, and any other related functions provided through the Platform;  
“User Account” means the user account created with ECSB when you register for the Service;  
“User”   means the individual person who access Platform and uses the Service. Detailed definition of User Type is provided in below in: 2. User Types & Access Rights.
  1. Use of Service

    ECSB provides the following key services in the Platform:

    • Financing Eligibility Check (named as CarCulator on the Platform)
      Refers to the proprietary online tool provided on the Platform that enables users to estimate monthly loan repayments and evaluate financing options based on vehicle price, loan tenure, down payment, and other relevant inputs. It is intended for informational and preliminary assessment purposes only and does not constitute a formal loan offer or commitment. Any financing eligibility or estimated repayments generated by this tool are subject to final approval, credit checks, verification of supporting documents, and other applicable terms and conditions.
    • HP Loan Application Submission
      Refers to the process by which a Customer, with or without the assistance of a Sales Representative, completes and submits the required information and documents through the Platform for the purpose of applying for a vehicle financing facility with a participating financial institution.
    • Value-Added Service
      Refers to any additional product, feature, or offering made available through the Platform that complements the primary loan application process.
  1. User Types & Access Rights

    The Platform supports three types of users:

    • Customer
      1. May access the CarCulator tool without registration.
      2. Must create an account to submit loan applications and opt for value-added Service.
    • Sales Representative (of Partner Dealers)
      1. May access the CarCulator and submit applications on behalf of customers.
      2. Must have a registered account.
      3. Users with managerial roles may manage their dealership’s information.
    • Financial Partners / User
      1. May review loan applications submitted via the Platform.
      2. Must have a registered account.
      3. Users with managerial roles may manage their organization’s user access and profile.
  1. Data Collection & Sharing

    By using the Platform, you acknowledge and consent to the collection, use, processing, and sharing of your personal, financial, and transactional data by ECSB, for purposes including, but not limited to the following:

    1. to facilitate and manage vehicle loan applications and related services;
    2. to assess eligibility and risk through internal credit scoring or evaluation models;
    3. to improve and enhance the Platform’s services and user experience; 
    4. to conduct marketing, promotional, or awareness campaigns;
    5. to contact you for feedback, reviews, or testimonials regarding your experience with the Platform or its services.

    Your data may also be shared with ECSB’s current and future partners and affiliates for the purposes stated above, and always in compliance with applicable data protection laws.

    You may opt out of certain uses of your data for marketing or promotional purposes by contacting us as outlined in our Privacy Notice.

  1. Privacy & Security

    We implement stringent technical and organizational safeguards in line with industry best practices to protect your information from unauthorized access, use, disclosure, alteration, or destruction. By using the Platform, you consent to the processing of your data in accordance with our Privacy Notice.

  1. Privacy & Security

    ECSB strives to ensure the continuous availability of the Platform. However, access may be interrupted or limited due to maintenance, system upgrades, technical issues, or factors beyond our control. We reserve the right to modify, suspend, or discontinue the Platform, in whole or in part, at our sole discretion and without prior notice.

  1. User Responsibilities

    By using the Platform, you agree to:

    1. provide accurate and up-to-date information;
    2. keep your login credentials secure;
    3. comply with all applicable laws and regulations; 
    4. use the Platform responsibly and ethically; 
    5. report any unauthorized access or suspicious activities immediately.
    6. ensure that any personal or financial information provided on behalf of another individual (e.g., Customer, guarantor) is obtained lawfully, with appropriate consent, and submitted in a manner that respects privacy and data protection obligations.
    7. not use the Service for any unlawful purpose or in a manner that will result in any criminal or civil liability for ECSB;
    8. not create a false identity, mislead others as to the origin of messages, or impersonate any person or entity;
    9. not post, transmit, or distribute material that is defamatory, obscene, unlawful, harassing, or infringes on the rights of others;
    10. not distribute spam, junk mail, or engage in unauthorized advertising through the Service; and
    11. not interfere with, disrupt, or attempt to gain unauthorized access to any part of the Platform or its related networks.
  1. Trademark Notice

    This Platform includes registered trademarks and trademarks which are the subject of pending applications, or which are otherwise protected by law.

    You may not use such trademarks or the names ECSB or any trademarks registered (or otherwise) belonging to ECSB, except as permitted in the Terms or with the specific prior written permission of ECSB. This Platform may contain the trademarks of content suppliers and electronic commerce merchants, which are protected by law, and you may not use these trademarks, at all times. All Platform content, including but not limited to trademarks, text, design, graphics, and software, is the property of ECSB or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

  1. Copyright Notice

    This Platform and its contents including but not limited to text, graphics, images, logos, button icons, audio clips, and software are owned or controlled for these purposes by ECSB or its content suppliers and are protected by copyright, trademarks and/or other intellectual property rights and other laws of Malaysia. You may view this Platform and its contents using your web browser and save an electronic copy, or print out a copy, of parts of this Platform solely for your own information.

    You are restricted from modifying, in any way, the contents from how it appears on this Platform or any site belonging to ECSB. You must not reproduce, transmit (including broadcast), adapt or otherwise exercise the copyright in the whole or any part of this Platform or website for any other purpose except as expressly permitted.

    The compilation (including but not limited to the collection, arrangement, and assembly) of all content on this Platform is the exclusive property of ECSB and protected by copyright. All software used on this Platform is the property of ECSB or its software suppliers and protected by copyright.

  1. Disclaimers

    The Platform is provided on an "as-is" and "as-available" basis. We do not guarantee:

    1. that loan applications will be approved;
    2. that approved applications will match the requested loan amount and/or tenure;  
    3. that interest rates or loan terms are final until confirmed by Financial Partners;
    4. the accuracy of information from third-party sources; 
    5. that the processing, approval, and disbursement of any loan is subject to the terms, conditions, legal requirements, and internal policies of the respective Financial Partners. Users acknowledge that once a loan application is submitted to a Financial Partners , it will be governed by that Financial Partners applicable terms of use and legal obligations, which may differ from those of the Platform; 
    6. that the estimates provided by the CarCulator tool are accurate, final, or reflective of actual loan offers. The CarCulator is intended for informational and simulation purposes only, and the actual loan terms will be determined solely by the Financial Partners upon formal application.
  1. Limitation of Liability

    ECSB, its agents and representatives, and its suppliers (including software or content suppliers) (hereinafter collectively referred to as “Suppliers”) will not be liable to you or any other party for any loss, damage, expenses or liability (including consequential loss or damage), loss of business, revenue or profits suffered or incurred by you or any other party which arise:-

    1. from circumstances beyond any of the Suppliers’ control or from your acts, omission, default or negligence;
    2. from our deletion or failure to store any messages or other communications maintained or transmitted by the Service;
    3. directly or indirectly in respect of the Service or any failure or omission by ECSB to comply with any of the Terms.

    If any claim arising out of, or in connection with the relationship established by the Terms result in any of ECSB, its agents and representatives becoming liable for any loss or damage not capable of exclusion under these Terms, then ECSB, its agents and representatives’ total liability for such loss is limited to Ringgit Malaysia One Hundred (RM100.00).

  1. Data Retention

    We retain user data for as long as necessary to:

    1. comply with applicable legal, regulatory, and contractual obligations;
    2. support internal audit, compliance, and servicing processes;
    3. improve, enhance, and analyze the performance and functionality of the Platform; 
    4. resolve disputes, prevent fraud, and enforce our Terms.

    Upon account closure, your data may remain in secure archived systems as permitted or required by law, solely for legitimate business or legal purposes. ECSB will take reasonable steps to securely delete or anonymize personal data when it is no longer required.

  1. Amendments to Terms

    ECSB reserves the right to modify for any reason whatsoever or discontinue (temporarily or permanently) this Platform at any time and from time to time with or without notice. You agree that ECSB shall not be liable to you or to any other party for such modification, suspension or discontinuation of this Platform.

  1. Governing Law & Jurisdiction

    By accessing and using this Platform and/or the Service, you agree that such access and/or use, as well as the Terms shall be governed by and construed in accordance with Malaysian laws, and you agree to submit to the exclusive jurisdiction of the Malaysian courts.

  1. Cookies

    ECSB may track your visit to the Platform by giving you a “cookie” when you enter. Cookies are pieces of information that websites transfer to your computer’s hard drive for record-keeping purposes. We use cookies to make visiting our sites and our partner sites easier. Cookies allow ECSB to save passwords and preferences for you so that you will not have to re-enter them the next time you visit. Cookies also help ECSB track user trends and patterns. Cookies also help ECSB collect anonymous click stream data for tracking user trends and patterns. In addition, third party advertising networks may issue cookies when serving advertisements. The use of cookies is now an industry standard, and you will find them used on most major websites. Most browsers are initially set up to accept cookies. If you prefer, you can reset your browser either to notify you when you have received a cookie, or to refuse to accept cookies. You should understand that areas of certain sites will not function properly if you set your browser to not accept cookies.

  1. Implied Licenses

    ECSB grants you a limited license to access and make personal use of this Platform and not to download or modify it, or any portion of it, except with prior express written consent of ECSB. This license does not include any resale or commercial use of this Platform or its contents. This license does not include any use of data mining, robots or similar data gathering or extraction tools. This Platform or any portion of this Platform including without limitation the materials used and displayed on this Platform may not be reproduced, duplicated, copied, sold, resold, republished, downloaded, posted, distributed, disseminated, broadcast, transmitted or otherwise exploited for any commercial purpose except for your own reference. Any other use requires the prior written permission of ECSB. You agree not to adapt, alter or create a derivative work from this Platform or any portion of this Platform including without limitation the materials used and displayed on this Platform or use them for any other purpose other than for the purpose stated in this paragraph.

    You may not frame or utilise framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page, layout, or form) of ECSB without express consent. You may not use any meta tags or any other “hidden text” utilising names, logos or trademarks belonging to ECSB without express consent of ECSB. Any unauthorised use terminates the permission or license granted by ECSB herein.

    Nothing contained in this Platform shall be construed as conferring by implication, or otherwise, any license or right under any patent, trademark, copyright (except as expressly provided in the Terms) or any proprietary rights of ECSB or its licensors.

  1. Indemnity

    You must indemnify ECSB and hold ECSB harmless against all loss, costs, damages, expenses and liability arising from:-

    1. the use by you or any other person of this Platform and/or the Service whether or not expressly authorised by you; or
    2. any material posted on, transmitted or received via this Platform and/or the Service; or
    3. breach of any of the Terms.
  1. Linked Sites

    This Platform may contain links to third party sites. ECSB are not responsible for the condition or content of those sites. The link(s) are provided solely for your convenience and do not indicate, expressly or impliedly, any endorsement, authorization or sponsorship by ECSB of those site(s) or the products or services provided there. You access those sites and use their products and services solely at your own risk. ECSB are not responsible for any transactions you may perform on those sites.
